a socially relevant rantage

Yun o. Sumo-socially relevant. Kasi naman, nakakaloka talaga ang mga kaganapan recently. Naisabatas ang Republic Act No. 10175 habang tayong lahat ay abala sa pangbu-bully diumano kay Sen. Sotto. 

Hindi man ako kabilang sa propesyon ng kursong tinapos ko, galit ako sa pagkakapasa ng batas na ito. Blogger rin naman ako kahit kadalasan eh ang Universe lang ang inookray ko at wala naman yata akong libelous entries whatsoever.

Pero naman. Napaka-basic naman ng Art. III, Sec. 4 ng 1987 Constitution. No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances. Minemorize namin ito as UPJC applicants (haha) at isa ito sa dalawang legal provisions* na alam ko by heart bago ako mag-Law. 


Oh well. What do you expect? Napakagagaling ng ating mga mambabatas. Napakagaling nilang umepal, mangurakot, magpayaman at mangamkam ng kapangyarihan. Mga leche kayo! Magtrabaho naman kayo paminsan-minsan, utang na loob! Hindi ito libelous, promise.** Assuming arguendo that the preceding statement is libelous, hindi pa rin ako liable sa ilalim ng prospectivity principle ng criminal law.*** Bwahaha.

Kaya hindi ko rin masisisi ang ilang mga "hacktivist" sa kanilang kilos protesta kamakailan.

*Yung isa e Art. 353 ng Revised Penal Code na minemorize naman namin sa Ethics at sa Mass Media Law.
Art. 353. Definition of libel. A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead.
**The elements of libel are: 1) The imputation of a discreditable act or condition to another; 2) publication of the imputation; 3) Identity of the person defamed; and 4) existence of malice.
***Penal laws have prospective application unless they are favorable to the offender who is not a habitual delinquent. October 3 pa ang effectivity ng batas na ito, ayon sa isang ulat at hindi naman ako habitual delinquent.
